Terms and Conditions

These rules explain how to enter, how the winner will be selected and verified, and how entrant information will be used. Please read them before entering.

1. Promoter

The promoter is SAFARI SA (PTY) LTD, registration number 2013/049232/07 with its principal place of business at 22 Main Street, Plettenberg Bay, 6600 (SafariSA)

By submitting an entry, you confirm that you have read and agree to these Terms and Conditions.

2. Competition period

The competition opens on 8 October 2026 and closes at 23:59 South African Standard Time on 28 October 2026. Entries received after closing will not be accepted.

3. Who may enter

The competition is open to natural persons who are at least 18 years old, currently living in South Africa, and able to provide a valid South African delivery address and contact details.

The following people may not enter or win: employees, directors, members, partners, agents or consultants of SafariSA or the Festival; employees or representatives of any supplier involved in this competition; advertising, promotional or other agencies involved in the competition; any associated company of SafariSA or the Festival; and the immediate family or household members of any of those people. A person is also ineligible where a connection to SafariSA, the Festival or a competition supplier or agency could improperly influence, or reasonably appear to influence, the competition.

A person who is legally prohibited from receiving or using the prize is not eligible to win it.

4. How to enter

To receive one standard entry, an eligible person must complete and submit the official online competition entry form and provide the information requested on that form.

An entrant may receive one additional entry by uploading a photograph of their favourite bird through the competition entry mechanism. The photograph must have been taken by the entrant or be one the entrant has the lawful right to submit.

Each person may submit no more than two entries in total: one standard entry and one qualifying bird-photograph entry. No purchase is necessary. There is no entry fee; an entrant is responsible only for their ordinary internet or data costs.

5. Bird photographs

The entrant remains the owner of a submitted photograph. By submitting it, the entrant confirms that they have the rights needed to submit it and that it does not unlawfully infringe another person’s rights.

The photograph is used to qualify for the additional entry and to administer the competition. SafariSA will obtain separate permission before using the photograph for other marketing or promotional purposes.

6. Prize

There is one prize: one Vortex Viper HD 8x42 binocular, with an approximate advertised retail value of R11949.

The prize is non-transferable and may not be exchanged for cash. The prize is subject to availability. No winner will be required to pay money to claim it. If circumstances genuinely outside SafariSA’s reasonable control make it impossible to provide the advertised prize, SafariSA may substitute a prize of equal or greater value, subject to applicable law.

7. Draw, provisional winner and verification

After the competition closes, one provisional winner will be selected by random draw from all valid entries received before closing. Each valid standard entry counts once, and each qualifying bird photograph adds one entry.

The draw and competition process will be overseen and certified by an independent accountant, registered auditor, attorney or advocate, as required by law. SafariSA will keep the prescribed competition records for at least three years.

Selection does not itself award the prize. The selected entrant is only a provisional winner until SafariSA has verified their identity, age, South African residence, eligibility, entry validity and compliance with these rules. The prize is awarded only after successful verification and confirmation by SafariSA.

SafariSA may request reasonable supporting documents for verification. Information requested for verification will be used for competition administration and legal compliance, in accordance with the privacy terms below.

8. Disqualification and redraw

SafariSA may disqualify an entrant or provisional winner where it reasonably believes that the entrant:

has breached these rules or is ineligible; supplied information that is false, misleading, incomplete or materially inaccurate; manipulated or attempted to manipulate the competition, draw or entry process; used duplicate entries beyond the permitted limit, automated tools, bots or other unauthorised means; acted fraudulently or dishonestly; submitted material that infringes another person’s rights; or has a prohibited relationship or connection described in clause 3.

SafariSA may also disqualify an entrant on other reasonable grounds that show non-compliance with these rules or applicable law. A disqualification decision will be made in good faith on reasonable grounds.

If a provisional winner is disqualified, fails verification, declines the prize, or does not respond within five business days after SafariSA’s reasonable attempts to contact them, SafariSA may draw or select a replacement winner from the remaining valid entries. The replacement winner will also be provisional and must pass verification before the prize is awarded.

9. Winner notification and prize delivery

SafariSA will contact the provisional winner using the details supplied on the entry form and may make reasonable attempts to reach them. The winner may collect the prize from SafariSA in Plettenberg Bay or arrange delivery to a valid South African address. The prize will not be delivered outside South Africa. Delivery or collection arrangements will be agreed directly with the verified winner.

10. Publicity

A winner may be invited to have their name announced, take part in a prize handover, or participate in publicity relating to the competition. Any such participation, image use or marketing activity is voluntary. The winner may decline without losing the prize. Separate permission will be obtained for any publicity use requiring consent.

11. Personal information

SafariSA will process personal information submitted for the competition in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). This may include an entrant’s name, contact details, location, delivery address, entry details and uploaded photograph, and a provisional winner’s reasonable verification information.

SafariSA uses this information to receive and validate entries, administer the draw, contact and verify the provisional winner, deliver the prize, prevent fraud or duplicate entries, respond to enquiries, meet legal obligations and retain records required by law. Entry-related processing is necessary to administer the competition and is not consent to receive marketing.

Information may be shared with service providers and authorised persons only to the extent reasonably necessary to run the competition, deliver the prize, verify the draw or meet legal obligations. SafariSA will take reasonable technical and organisational measures to protect it. SafariSA will retain personal information only as long as reasonably necessary, subject to legal retention requirements; prescribed competition records will be retained for at least three years.

The entry form will identify which information is required to administer the competition. If required information is not provided, SafariSA may be unable to accept or administer the entry. The privacy notice will identify any additional recipients and any transfer of personal information outside South Africa, if applicable.

Entrants may request access to or correction of their personal information and may exercise other rights available under POPIA, including objecting to or restricting processing where applicable. They may also complain to the Information Regulator. Privacy enquiries may be sent to the Information Officer at [insert name/designation and privacy email]. Privacy notice/policy: [insert URL].

12. Marketing consent

By agreeing to these Terms and Conditions, the entrant consents to SafariSA using the entrant’s contact details to send marketing communications about SafariSA products, offers, promotions, competitions, events and specials by email and SMS/WhatsApp.

Consent to receive these marketing communications is a condition of entering the competition. The entrant confirms that the contact details provided are theirs and that they agree to receive the communications described in this clause.

The entrant may withdraw consent or unsubscribe at any time by using the unsubscribe method in a message or contacting hello@safarisa.net and SafariSA will stop sending direct marketing after receiving the withdrawal request. Withdrawal does not affect competition administration messages reasonably needed to run the competition.

13. Indemnity and limitation of liability

To the maximum extent permitted by applicable law, an entrant indemnifies SafariSA, the Festival and their respective associated companies, directors, officers, employees, agents, suppliers and agencies against third-party claims, losses, damages, costs and expenses arising from the entrant’s breach of these rules, unlawful conduct, fraud, or infringement of another person’s rights, including in relation to a submitted photograph.

To the maximum extent permitted by law, SafariSA and those related parties will not be liable for indirect or consequential loss, or for loss arising from an entrant’s acts or omissions, or from events reasonably beyond their control. Nothing in these rules excludes or limits liability to the extent that it cannot lawfully be excluded or limited, including any non-excludable liability under the Consumer Protection Act, POPIA or other applicable law, or any consumer right or remedy that the law does not permit the parties to waive. No entrant indemnifies a related party for that party’s own conduct to the extent that such an indemnity is prohibited by law.

14. General

SafariSA is not responsible for entries that are lost, delayed, corrupted, incomplete or not received because of technical circumstances beyond its reasonable control.

SafariSA may amend, suspend or cancel the competition only where reasonably necessary because of circumstances beyond its reasonable control or where required by law. Any material change will be communicated appropriately and will not unfairly prejudice entrants.

If any provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law. These rules are governed by the laws of the Republic of South Africa. Nothing in these rules limits rights or remedies that cannot legally be excluded.
